and General conditions of supply of hydraulic cylinders in FMB Bumar Sp z o.o. A. GENERAL 1. Execution of hydraulic cylinders takes place under conditions contained in the present offer based on orders received from he Client according to the design documentation supplied by the Client or the documentation prepared by the Contractor and approved by the Client. 2. The implementation of an order begins after the fulfillment of conditions proposed by the Contractor, especially financial conditions. 3. Force majeure events such as strikes, blockades and other conditions rendering impossible to execute an order (independently of whether they take place at the Contractor or his sub-contractors) and damages of chrome-plating plant (belonging to a sub-contractor) entitle the Contractor to extend the delivery time by the time of their duration. 4. Prices of hydraulic cylinders are loco warehouse of Contractor 5. The Client commits himself to take delivery and pay for hydraulic cylinders within 7 days from the receipt of notification on their execution. 6. The Client takes possession at his own expense of hydraulic cylinders after having been notified by the Contractor or it is his transport company on the account of the Client. The Client has to supply transport safeguarding 7. Delivery of hydraulic cylinders takes place after having received a copy of money transfer, of check confirmed by the bank of the Client or by cash. 8. The delay in the payment for the hydraulic cylinders presented for delivery (over 7 days) authorizes the Contractor to charge interest according to the regulations in force and causes halting to execute further orders. The time to halt the implementation of the order for this reason is not regarded as a delayed execution. 9. Canceling or reduction by the Client of the order obliges the Client to cover costs incurred to execute orders such as payment for products manufactured, production -in-course (according to the inventory of goods) and materials purchased, if they can not be used by the Contractor to manufacture other products. 10. Client is entitled to submit a claim according to the terms defined below resulting from the guarantee. A guarantee is awarded for a period of 12 months for a new hydraulic cylinder and 6 months for a repaired hydraulic cylinder or a repaired part counting from the 15th day from the notification of the client on the delivery. The faults discovered in this period shall be made good free of charge after the delivery of the hydraulic cylinder in question to FMB "Bumar" Sp z o.o. in Choszczno, ul. Fabryczna 6. 1. Guarantee shall be respected after the delivery by the Client of the hydraulic cylinder in question along with the guarantee card and violating the leaden seal after the preceding substantiation of the validity of the claim. 2. Guarantee provides for free spare parts to the hydraulic cylinder and the cost of labor to replace these parts or of their repair and cost of their transport on the territory of Poland. 3. The Client or his representative is entitled to witness the dismantling the said hydraulic cylinder during which a protocol of inspection 4. After the recognition of the validity of the claim the hydraulic cylinder shall be immediately repaired and the Client shall be informed in writing about possible reasons of the delay. 5. Guarantee comprises only the faults of the hydraulic cylinder caused by faulty assembly, use of inappropriate materials or their faulty execution. 6. Guarantee does not comprise faults caused by improper exploitation, mechanical damage, impurities, improper installation or servicing. 7. Guarantee does not include costs other than those enumerated in point 2 above and in particular costs of assembling and disassembling as well as cost of halt of equipment in which the hydraulic cylinder has been used. 8. Guarantee due to faulty operation of packings will be recognized provided that the impurities found in the hydraulic fluid shall not exceed the purity class 17/13 according to ISO 4406. 9. FMB "Bumar" Sp. z o.o. can not be accountable for a delayed repair due to force majeure such as strikes, blockades, etc. |
